On Friday March 6, 2009, I was filming the surrounding scene of a police investigation from a sidewalk, that is open to the public. It turns out, a male may have possibly committed suicide inside of his white toyota tacoma pickup truck with a gun / firearm. There was a visible bullet hole and shattered glass lay around the white truck. As, I filmed I received glaring attention and an officer for Tomball Police Department, called sergeant Gary Hammond approached me, and did not seem to like me there filming this public scene at all. Sgt. Gary Hammond, in a not so asking tone, basically warned me that he was going to ask me to put away the camera and leave where I was. I do not know how Tomball Police Dept. or Sgt Gary Hammond typically handle photographers / videographers, but I was assisted or welcome at all. Instead, while I peacefully filmed, away from the taped off area, on a sidewalk, I was questioned and made to feel as if the situation would escalate if I didnt cooperate with G. Hammond's so-called request. This exchange is also on film, as you can see the the footage, where I filmed from the parking lot area behind the Diagnostic building in Tomball. Scribe from the video: It did not sound like he was really asking (officer G Hammond), and with his hands hovering above a gun and taser, I felt he was becoming aggressive. I had been filming peacefully, from a sidewalk, in an area open to the public. No property controllers / owners had asked me to stop filming or to leave the premise Sgt. Gary Hammond of Tomball Police Dept. approached very closely and seemed to me to have a coercive forceful tone and stance, so I left peacefully out of concern my rights may not matter to him. I wanted to ask by what law I was required to leave, since I had not been asked by the property owners to do so, but once again he didn't seem to be interested in my rights to film and so to avoid him possibly physically assaulting me, I was as cooperative as possible. He may be a "good 'ol boy / small town officer" so to speak, but it seems to me, we still have the right to film in public, whether some officers have a personal problem with it or not. Being approached by an authoritative figure (also: tax payer salary) while you are doing your best to film peacefully in a public area, in this manner, seems like unlawful coercive harassment of my rights, to me. And without a court order or a property controller's known request, I was approached. This type of thing happens often around the world. I believe posting the footage is the most helpful thing I can do with this, for myself and other photographers / videographers. The Texas legislature is a joke. These politicians can't even follow their own rules. When they break their rules they won't punish the people. Rep. Debbie Riddle, someone who wants to ensure people vote only once with strict laws, cast several votes under other people's names. Debbie Riddle is your classic Texas Bible-thumping conservative Republican. The religious-conservative fundies have no problem with cheating and breaking their own rules.
