URL: Jamaican drug dealer fights for property in UK courts Jamaican drug dealer fights for property in UK courts Thursday, 15 May 2008 Convicted Jamaican drug dealer Owen Clarke has won permission to challenge the UK s attempt to strip him of his assets. Clarke, 50, popularly known as ‘Father Fowl was the leader of an international drug ring for many years. Clarke s hold on the international illegal drug market spanned at least five countries. In June 2004 he was found guilty in a London court for producing, supplying and possessing crack cocaine. He was sentenced to 13 years which was later slashed to 11 after he made an appeal. In September 2006 he was slapped with a confiscation order with a threat of four more years in jail if he did not pay up. The courts heard Clarke say he made his fortune as a music promoter but never kept accounts, paid taxes or opened a bank account. He led such an elaborate lifestyle that he boastfully burned 50 pound notes, drove a super charged Mercedes motor vehicle and owned a string of properties in Britain and the Caribbean. In Jamaica Clarke drove a Jaguar XKA convertible with the personal license plate ‘007 . The diamond encrusted crucifix he wore around his neck was worth 10,000 pounds. The judge at the confiscation order had ruled that he made 578,403 pounds from his crimes of which just 288,782 pounds was recovered. However last week at the Criminal Appeal Court his lawyers argued that part of the ruling should be overturned as there was no evidence to suggest he owned a house in Jamaica or a valuable Volvo car. The judge agreed Clarke did not own the car after they considered evidence from its new owner to say he had not transferred the relevant documents at the time of Clarke s arrest. Permission to appeal against that part of the judge s findings on the confiscation order was therefore granted. A date for clarke s hearing has not yet been set. Under SoundExchange's latest proposal, smaller webcasters would remain exempt from the new royalty schedule until 2010. Large, commercial webcasters would have to still have pony up beginning in mid-July. Download ASID SAYS NO to Play-OLA and the CRB Pirates URL: New Webcast Royalty Rules Will Line SoundExchange's Pockets With Billions In 'Administrative Fees' There's been plenty of backlash against the new royalty rates for webcasters, set by the Copyright Royalty Board at the suggestion of SoundExchange, a group spun out from the RIAA to handle royalty collection. The royalty rates themselves were ridiculously high, and would make it untenable for many small webcasters to continue, while taking a huge bite out of bigger players' revenues. Now, four of those bigger companies -- Yahoo, RealNetworks, Pandora and Live365 -- have sent a letter to lawmakers pointing out that not only do they have to pay the inflated royalties, they have to pay SoundExchange more than $1 billion a year in "administrative fees" for collecting them as well. The new royalty deal levies a charge of at least $500 per "channel" on webcasters, which SoundExchange says is to cover administrative costs. For somebody like Real, that adds up quickly, since it says it served 400,000 unique channels to its subscribers last year. Furthermore, since they're not royalties, there's a good chance they'll just line SoundExchange's pockets rather than be distributed to artists. This isn't particularly surprising, given SoundExchange's track record (nor its affiliation to the RIAA), but further illustrates how one-sided this royalty deal is. It was crafted only to benefit SoundExchange, and not the artists it purports to represent -- and it certainly doesn't do much for webcasters, other than decimate their industry. Hopefully the webcasters' letter will give a boost to the bill that's been introduced to overturn the CRB decision and set much more reasonable royalty levels.

The rate hike puts internet radio royalty rates more than four times higher than satellite radio rates, while terrestrial radio broadcasters don't have to pay at all. We all know terrestrial radio's music programming sucks, satellite radio is expensive, and HD radio is a scam. So let's save internet radio! The survival of Pandora and all of Internet radio is in jeopardy because of a recent decision by the Copyright Royalty Board in Washington, DC to almost triple the licensing fees for Internet radio sites like Pandora. The new royalty rates are irrationally high, more than four times what satellite radio pays, and broadcast radio doesn't pay these at all. Left unchanged, these new royalties will kill every Internet radio site, including Pandora.In response to these new and unfair fees, we have formed the SaveNetRadio Coalition, a group that includes listeners, artists, labels and webcasters. (AHN) - The Copyright Royalty Board has issued a ruling which will require Internet and streaming radio stations to pay the same royalties that traditional radio stations must pay to the music labels which own the songs they play. Furthermore, the case approved charges retroactively to 2006, meaning many smaller music-streaming and radio-station sites will have to pay far more than they expected, and face shutting down under the enormous costs. Now, only Congress can help smaller web-based radio stations. Currently, Internet radio has been seen as one of the challengers to satellite radio, and actually named as a reason why the Sirius and XM Radio merger wouldn't be an unbeatable trust, since the variety and availability of free Internet radio stations would add competition in the industry. However, now that these stations may go under, Congress may have to intervene. Part 1 of a special five-part series. Mark Sullivan, PC World Tuesday, April 17, 2007 06:00 PM PDT Internet radio stations are mobilizing in the wake of a potentially costly new royalty fee structure approved earlier this week by the Copyright Royalty Board (CRB). The board decided Monday that commercial Internet radio stations, regardless of their size, will pay a new, higher flat fee to the record labels each time a song is played. The increase applies to songs played in 2007, and retroactively for 2006 at a slightly lower rate. As it stands now, the rates will go into effect in about a month. "The CRB's ill informed decision to increase royalty fees to this unjustifiable level will quite simply bankrupt most webcasters and destroy Internet radio," says the Net radio stations' newly formed coalition, SaveNetRadio.org. SaveNetRadio says the move will increase its member stations' rates between 300 percent and 1200 percent, depending on the station's size. Stations Fear Fees Too Onerous Internet radio isn't a very lucrative affair to begin with, and the fee increase will put many out of business, the stations say. Their royalty payments, they complain, will exceed their revenues. "It makes our business financially unviable," says Tim Westergren, founder of the Internet radio station Pandora. Westergren estimates that his company will end up paying out about 60 percent of its revenues in royalty fees once the new rates kick in. Westergren says his company is funded by venture capital firms and has yet to reach profitability. He says that getting Pandora into the black wouldn't be easy even with the existing royalty fee structure. With the higher rates, he says, it might be impossible. The Royalty Board has no understanding of the Net radio business, Westergren says. "The ruling was a flat per-song rate, and it's set at a level that makes recouping that and building a business on it impossible." Another Net radio broadcaster, KCRW in Santa Monica, estimates that--with the new rates--it will pay $140,000 in copyright royalties for 2006, and $190,000 for 2007 (based on the station's January 2007 traffic levels). Since KCRW is a public radio station that does both terrestrial and Internet broadcasting, the new royalties aren't likely to kill it. But it'll hurt. "It's going to cost us money that we didn't plan for," says KCRW station manager Ruth Seymour. "We will be paying for each song every time it's heard by one listener." Payment Plans Seymour explains that the Internet radio stations appealed to the Royalty Board to adopt a system that exacts royalties that are at least partially based on the revenues of the stations. But, she says, under the influence of the record labels, the board refused. SoundExchange, the organization that collects Internet radio royalties for the record labels, says the radio stations have had it pretty good. John Simson, the organization's executive director, says the station's royalty payments have not increased since 1998, and that the stations knew proceedings to increase the rates were going on. Simson acknowledges that the new rates will make it tough for some. "I think there are a lot of stories being told under one banner here," Simson says. "I think there are services that can easily afford the rates, and then there are some services that will struggle with those new rates." Simson makes it clear that his side is willing to negotiate. "We're interested in discussing business solutions with them, but right now they only seem interested in making noise," he says. The Jamaica Star :: Entertainment :: Bertus' time to shine :: April 13, 2007 Bertus' time to shine Bertus - Anthony Minott by Leighton Williams, Projects Coordinator If there's anything that can be said about Marlon Ainsworth otherwise called 'Mr. Bertus' it would be that he wants to become a household name across the world. "The world has not seen me yet but I'm coming to take it full force because I have the talent to become known and that's why I'm working hard to get my name out there," he told The STAR. Mr. Bertus came up with his name after he decided to shorten Robert - his given name. He decided to add Mr. because his friends told him 'Bertus' was 'too dry'. He has been singing and deejaying since he was a child. He said the first time he was ever allowed to touch a microphone was when veteran deejay Josie Wales handed it to him at a party in his area one night. "I used to live in the Waltham area and there was a sound there called Lees Unlimited. Josie Wales was the M.C. I asked for a chance and he gave me the microphone and I started deejaying," he said. Since then, Mr. Bertus has worked to develop his career. He said he later moved to Portmore where his brother deejayed on a sound called Black African. Mr. Bertus said this was his motivation to become involved in the music full time. While he has been involved in the music full time he admits it has been difficult. "I find that when people know that you are aware of the music business you get a fight, but I have been working hard. I direct my own videos and I also try to produce my own stuff," he said. To date, Mr. Bertus has recorded several singles, his most recent being Reckless Life, a single about his lover who walked out of his life because he was spending too much time in the studio. He also has other singles which he has posted on his website and his myspace blog. In addition, he has performed at Sting, in the Turks and Caicos Islands and London. Additionally, he said he has opened for other artistes such as Sanchez and has also written songs for other artistes. He adds that he has secured dates to perform in Curacao later this year. He adds that he has done work with Phillip Arnett from Shore Jam label and is hoping that the new singles and videos will really be a launching pad for success. This is the preamble to Capleton's Heathen Rage, and has been characteristic of Rastafarian artistes over the years. It is the first of April but having a 'follicularly' challenged social scientist advocating Rastafari is no (Uncle) Tom Fool Day joke. Don't be fooled by the photograph. It is perhaps the only way that I can show 'brilliance'. Despite my bald head I sure as hell am not a 'Ball Head.' In any event, like Rastafarians, I use no comb and the name 'Dibaba' is Ethiopian. It was seven days ago, and it is clear why it could be called a 'weak end', because one of the most important days in the history of previously enslaved black people was commemorated. March 25, 1807, was the day when the English and American governments agreed that the transatlantic slave trade would end. The Americans saw it fit to do it a year later but the Brits gave it immediate effect. After much scholarship and activism within the body of intellectuals and others, there was finally a committee appointed by the Jamaican Government at the 10th hour in 2005. It is actually a self-appointed committee headed by my colleague, Professor Verene Shepherd. Empowered, without funds, by then Prime Minister P.J. Patterson, this group found a smattering of five million Jamaican dollars from the CHASE fund and had to obtain more than seven times that to research the details of Africans who lost their lives in the struggle against enslavement. Committee appointed At 6:00 p.m. last Sunday morning, a small but powerful group of broadcasters, Africans, intellectuals, activists, ordinary folk and 'whole heap a' Rasta gathered at the Kingston waterfront. The names of scores of victims of the trade were read, while the appropriately named Shepherd, led a tribute that read like an epic eulogy. No words from my lexicon can describe the 'vibe', but it was spiritual, beyond eerie and irie. It was well known that the politicians would be attending the afternoon session when we would have had the burial ceremony starting at 3:00 p.m. After all, that was their camera moment. Needless to say, I was terribly disappointed. First of all, the United Nations (U.N.) did not see it fit to mark the real anniversary but opted for the more convenient Monday, March 26. That is bad enough. But worse, it was such an insignificant day that cricket matches were scheduled. It is shameful that Antigua and Barbuda declared a national holiday to boost attendance at cricket while their celebrations were modest. Here, only one politician, Chief Pearnel Charles, with unblurred 'black and white vision', turned up for the more important morning session. The governing party, totally insensitive to the importance of the day, scheduled and had its National Executive Committee meeting. Bet you, Michael Manley, as white as he appeared, would not have disrespected our ancestors so. Even at the afternoon session, when we had visiting African dignitaries and the Governor-General, the parliamentarians were underrepresented. The nonchalance of our elected political leaders is shameful and shows exactly how 'unconscious' they are of the need to confront our past. Emotive speeches Never mind the emotive speeches by Bruce and Portia. none impressed me because it was them making political mileage. If they were really committed to the continuation and preservation of Marcus Garvey's dream then it would not have taken a last-minute push by Mike Henry to place the issue of reparations on the agenda. Detroit Man Sentenced for Child Prostitution 2007-03-16 02:06:52 - WASHINGTON, March 15 /PRNewswire-USNewswire/ -- Robert Lewis Young of Detroit was sentenced today to 25 years in federal prison for running a criminal operation prostituting adults and children, Assistant Attorney General Alice S. Fisher of the Criminal Division and Steven J. Murphy, U.S. Attorney for the Eastern District of Michigan announced. Following the 25-year sentence in federal prison, Young will face five years of supervised release for operating a prostitution ring spanning from Michigan to Hawaii. Young recruited and directed females -- including minors -- to engage in prostitution. Young transported women and children and facilitated their transportation across state lines by car and airplane. Young reaped substantial financial benefit and laundered the proceeds of his illegal prostitution activities with the help of co-conspirators. Young's sentencing comes after his plea of guilt to 26 offenses including sex trafficking of children, sex trafficking by force, fraud or coercion, transportation of a minor for criminal sexual activity, transportation for prostitution, sexual exploitation of children, possession and interstate distribution of child pornography, threatening interstate communications, possession with the intent to distribute marijuana, felon in possession of a firearm, money laundering, and use of an interstate facility in aid of racketeering. In addition, Young was also convicted of producing and distributing child pornography for his use on a Web site to advertise the availability of his prostitutes including a 17-year-old girl he exploited. As part of his sentence, Young was also ordered to forfeit property gained through and used in furtherance of his crimes including computer equipment, furs, clothing, jewelry, electronics and cash. Young's co-conspirators have also been convicted of their role in the prostitution operation. Young's Honolulu associates, Mark Luke White and Hae Sun Kim face sentencing later this year. Jeffrey McCoy, one of Young's co-defendants pleaded guilty and was sentenced in Hawaii earlier this year. A second Detroit associate, George Abro, who laundered the proceeds and assisted in the prostitution ring, pleaded guilty to federal offenses in October 2006 and will be sentenced later this year as well. A Chicago dentist, Dr. Gary Kimmel, is under indictment and charged with financial offenses related to his support of Young's organization and is scheduled for trial in September 2007. The investigation is being conducted by the FBI, Michigan State Police, U.S. Postal Inspection Service, IRS, the Detroit Major Crimes Task Force, the Detroit Police Department, and the Macomb County Enforcement Team. In Hawaii, the investigation was led by the Internet Crimes Against Children Task Force comprised of members from the State Attorney General's Office, the FBI, Immigration and Customs Enforcement (ICE), the U.S. Postal Inspection Service, and the Honolulu Police Department with substantial assistance from Assistant U.S. Attorney Wes Porter of the District of Hawaii. The case is being prosecuted by Trial Attorney Kayla Bakshi of the Child Exploitation and Obscenity Section (CEOS) of the Department of Justice's Criminal Division and Assistant U.S. Attorney John O'Brien of the U.S. Attorney's Office for the Eastern District of Michigan and Assistant U.S. Attorney Wes Porter for the District of Hawaii. In the spring of 2003, the Violent Crimes and Major Offenders Section of FBI headquarters, in partnership with CEOS and the National Center for Missing Exploited Children, initiated the Innocence Lost Initiative, designed to address the growing problem of children forced into prostitution. To date, the Innocence Lost Initiative has resulted in 275 open investigations, 697 arrests, 160 informations or indictments, and 136 convictions in the federal and state systems.
