Your voice was heard. Tuesday, US District Court Judge Louis Stanton signed off on an agreement by all parties in the lawsuit to allow Google to remove the names and identifying computer numbers of YouTube users from information it will provide Viacom, according to court documents. According to the agreement filed in New York federal court, the defendants shall substitute values while preserving uniqueness for entries in the following fields: User ID, IP (Internet protocol) address and visitor ID. YouTube is to assign each user a unique number so that individual viewing patterns can be determined without necessarily being able to figure out who viewers are. As they say, we have won the battle, but not the war. Keep up the support for our privacy.

John Cusack Sues Over 'Stopping Power'John Cusack Sues Over 'Stopping Power'
from Cinematical
July 10, 2008

Filed under: Deals, Celebrities and Controversy You remember that Jan De Bont flick John Cusack signed on for ages ago? The one that was going to give us a 51-minute chase scene? It was appropriately named Stopping Power, and it had so much flipping power that it stopped its own production back in October. Co-star Melissa George then swore it was still in the works, but that never went anywhere, and now Cusack is pissed. TMZ reports that he's filed a lawsuit against Intermedia Film Equities USA (you can see the documents on the site). According to the actor, the company convinced him to star in the ill-fated film, guaranteed that he would be paid $4.5 million, even if the movie didn't get made, and finally, that all of his expenses would be paid, which includes $50k to cover the cost of having his staff on location. Cusack's lawyer, Marty Singer, says that John got his butt to Germany, started production, and then was told that the company couldn't afford the guarantee. So, they're claiming the company fraudulently made these promises, and then wanted to renegotiate for a lower amount after ensnaring him. Johnny is looking for $5,600,000 plus punitives. Will John win? Or, will Film Equities have the final stopping power? Permalink | Email this | Comments

bswchannel.com Last week the divorce battle between Christie Brinkley and peter Cook went to court, and it looks like the claws are coming out. Cook was accused of spending thousands of dollars on pornography, cheating on his wife with an 18 year old assistant, and being a bad dad. At one point, Christie reportedly broke down into tears as she told the courtroom her "world was completely shattered" when she learned of her husbands affair. I don't know about you, but I'm rooting for Team Brinkley to bring home the gold. Let the games begin! Just when everybody thought he had fell off the face of the earth, news surfaces that eminem is still alive, and yes, still antagonizing people. A man has recently filed a lawsuit against the rapper over a bathroom brawl that went down in a strip club. E! news reports that the altrication took place two years ago in Detroit. In news of the pointless, but somewhat interesting, 15 year old teen queen Miley Cyrus proves she's wise beyond her years. In a recent interview with People Magazine, the singer/actress said she would describe herself as the "coolest peson, ev-er." Was she joking? Was she serious? The world may never know, but one thing is for sure, "She's just being Miley."

from Most Discussed

We have no way of knowing which click will lead us to a video w/ copyrighted material. Viacom has exclusive rights to it's copyrighted material unless the company grants another entity the right to use the material. Viacom has the right to know who has been fraudulently using their material. Viacom has the right to hold responsible the business who hosts and distributes their material. The average YT user, however, has no way of knowing from a thumbnail if a video will have copyrighted material in it. So, the average YT user shouldn't be held responsible for not being Miss Cleo. Her/His privacy should not be invaded. Anyone who steps out of line, can instantly be 'discredited' for clicking on a video of 'questionable' taste. Gimme 3 minutes of your time. VIACOM is pursuing Google, the owner of YouTube, for copyright issues. Judge Louis Lee Stanton has ruled that Google must turn over our YouTube member IDs along with the corresponding videos watched as well as our computers' IP addresses to Viacom. Copyright issues should concern those who've abused the copyright laws, not those who unknowingly watched the loaded clips. Surely Viacom knows this. This is a blatant invasion of privacy. Instead of whining about what corporations are doing, punish them. Boycott media. Try not spending anything for a couple of days. The following is a list of what Viacom owns. Google must divulge the viewing habits of every user who has ever watched any video on YouTube, a US court has ruled. The ruling comes as part of Google's legal battle with Viacom over allegations of copyright infringement. Digital rights group the Electronic Frontier Foundation (EFF) called the ruling a set-back to privacy rights . The viewing log, which will be handed to Viacom, contains the log-in ID of users, the computer IP address (online identifier) and video clip details. While the legal battle between the two firms is being contested in the US, it is thought the ruling will apply to YouTube users and their viewing habits everywhere. Viacom, which owns MTV and Paramount Pictures, has alleged that YouTube is guilty of massive copyright infringement. The UK's Premier League association is also seeking class action status with Viacom on the issue, alleging YouTube, which was bought by Google in 2006, has been used to watch football highlights. Legal action When it initiated legal action in March 2007 Viacom said it had identified about 160,000 unauthorised clips of its programmes on the website, which had been viewed more than 1.5 billion times. Following the launch of its billion-dollar lawsuit, YouTube introduced filtering tools in an effort to prevent copyright materials from appearing on the site. The US court declined Viacom's request that Google be forced to hand over the source code of YouTube, saying it was a trade secret that should not be disclosed. But it said privacy concerns expressed by Google about handing over the log were speculative . Google's senior litigation counsel Catherine Lacavera said in a statement: We are disappointed the court granted Viacom's over-reaching demand for viewing history. We will ask Viacom to respect users' privacy and allow us to anonymise the logs before producing them under the court's order. The ruling will see the viewing habits of millions of YouTube users given to Viacom, totalling more than 12 terabytes of data. Viacom said it wanted the data to compare the attractiveness of allegedly infringing video with that of non-infringing videos. YouTube and Google had compelled it to go to court, Viacom said, by continuing to defend their illegal and irresponsible conduct and profiting from copyright infringement, when they could be implementing the safe and legal user generated content experience they promise . It said it would not be asking for any personally identifiable information of any user. Any information that we or our outside advisors obtain will be used exclusively for the purpose of proving our case against You Tube and Google (and) will be handled subject to a court protective order and in a highly confidential manner. 'Erroneous ruling' Leading privacy expert Simon Davies told BBC News that the privacy of millions of YouTube users was threatened. He said: The chickens have come home to roost for Google. Their arrogance and refusal to listen to friendly advice has resulted in the privacy of tens of millions being placed under threat. Mr Davies said privacy campaigners had warned Google for years that IP addresses were personally identifiable information. Google pledged last year to anonymise IP addresses for search information but it has said nothing about YouTube data. Mr Davies said: Governments and organisations are realising that companies like Google have a warehouse full of data. And while that data is stored it is under threat of being used and putting privacy in danger. The EFF said: The Court's erroneous ruling is a set-back to privacy rights, and will allow Viacom to see what you are watching on YouTube. We urge Viacom to back off this overbroad request and Google to take all steps necessary to challenge this order and protect the rights of its users. The body said the ruling was also potentially unlawful because the log data did contain personally identifiable data. The court also ruled that Google disclose to Viacom the details of all videos that have been removed from the site for any reason.

A recent ruling in the Viacom vs YouTube/Google lawsuit threatens to invade the privacy of every YouTube viewer. That means even if you have broken no law you are considered guilty and subject to search. Probable cause is needed for a search. The judge must not have known that. Protest the decision: http://www.petitiononline.com/privacy9/petition.html The judge in the Viacom v. YouTube/Google case has just ordered that YouTube/Google turn over records of every viewing of every video since the site launched. That includes your private user data of every video you have watched. New York Times article: http://tinyurl.com/5td7hr Is it time to boycott Viacom? Or is it time to stop watching YouTube (to protect our privacy)? UPDATE: YouTube responds on their blog: http://www.youtube.com/blog?entry=Gh2N9xyKK8k UPDATE TWO: Since recording this, I've realized that my anger is misplaced. Viacom can ask for whatever they want, the real villain here is the judge who agreed with them, rather than follow the U.S. constitution's privacy provisions. Any protests should be focussed on the judge and the ruling (in a peaceful, non-violent, and legal manner, of course).
