The decision also tossed out the conviction of a North Carolina man once described as one of the worlds most prolific spammers. In 2004, Jeremy Jaynes of Raleigh, N.C. was the first person convicted under the law, enacted in 2003. Jaynes sent tens of thousands of e-mails through America Online servers in Loudoun, Virginia. Loudoun Circuit Court Judge Thomas D. Horne sentenced him to nine years in prison. Just six months ago, the same court upheld the anti-spam law by a 4-3 margin. But Jaynes's attorneys asked the court to reconsider, typically a long shot in appellate law, and the court not only reconsidered but changed its mind. The court overturned the law because it sought to outlaw all forms of unsolicited e-mail, not just commercial junk mail. In contrast, the Federal CAN-SPAM Act limits the restriction to messages used to promote a business or other financial gain. Jaynesemails were all commercial. But Jaynes sought to overturn the law itself as unconstitutional. Jaynes is currently in prison from an unrelated matter. Virginia Attorney General Bob McDonnell said he intends to appeal the case to the U.S. Supreme Court. At least 38 states have laws regulating spam.

Radical Entertainment, a video game company from Vancouver Canada announced that they will lay off 100 workers. Radical spokeswoman, Leah Rubin said that Activision Blizzard, the company’s owner, plans to reduce the number of titles that Radical produces in half. Last month’s merge and ownership change between radical and Activision… now known as Activision Blizzard are now being felt… through job cuts. Radical’s remaining teams will produce the latest Crash Bandicoot title and new world action game entitled, Prototype. Prototype is scheduled to have a 2009 release date.

Amidst the nations struggle with unemployment, the Ann Arbor community in Michigan can expect to hear some good news when it comes to job search because information technology consulting service agency, GDI Infotech, will be creating 121 jobs over the next five years. GDI Infotech applied for a high tech tax credit from the Michigan Economic Development Corporation’s Michigan Economic Growth Authority board, and once approved they plan to invest $1.9 million dollars in a physical expansion for their new operation entitled, the Solutions Division. The company says that the tax credit will help them restructure its office into a solutions and product division. The creation of new jobs will come from the health care, education, technology, and retail sectors and is expected to pay workers an average salary of $61,672. GDI assists businesses integrate information stored in “silos,” or disconnected computer technology systems.
