Dancehall dons anti-gay lyrics fuel local calls for Jamaica sanctions By SIGCINO MOYO In his book words to our now, Thomas Glave, SUNY Binghamton prof and gay Jamaican-American author, ponders the gnawing fear of the Jamaican LGBT experience. How will it happen? he asks of the all-too-inevitable violence faced by gays and lesbians in Jamaica. With fire gasoline machetes pickaxes hammers guns knives simple strangling or a good old-fashioned stoning Will our father do it to us, or a neighbour? A boyfriend, or a co-worker? Will everyone in our community turn on us? Considerable international attention has been given recently to anti-gay violence in Jamaica following a rash of deaths there. Elephant Man in Action The seeming Jamaican government authorities reluctance to do anything about it, despite calls from Amnesty International, has Helen Kennedy, the executive director of Egale Canada, the largest gay-lesbian group in this country, openly questioning the Harper government s pledge to dole out $600 million to bolster the infrastructure of Caribbean Community (CARICOM) countries over the next 10 years. Why are we using taxpayers dollars to support countries that don t observe basic human rights? Kennedy wonders. Jamaica still has a prohibition against the abominable crime of buggery on the books. And nowhere in recent talk of constitutional reform on the island is the issue of gay rights addressed. Egale is stopping short of calling for an all-out tourism boycott - the U.S.-based International Gay and Lesbian Travel Association says boycotts do nothing to help the LGBT communities there. But from Kennedy s perspective, queers should think twice about spending their bucks in the Caribbean country, as well as others with spotty records on gay rights. The group has joined Stop Murder Music Canada (SMM) in calling on immigration authorities to follow the lead of Britain and the U.S. and bar from entry into Canada reggae dancehall acts known for virulent anti-gay lyrics. So far, there s been a resounding non-response from higher up the political food chain. Capleton The FireMan In what Kennedy calls an all-out campaign, Egale and SMM have set their sights on local promoters, bookers and venues, forcing the recent cancellation of shows featuring some of the more notoriously anti-gay dancehall dons - Capleton, Baby Cham and Beenie Man, all skedded for GTA-area gigs. Baby Cham Shows by Sizzla and Elephant Man were called off a few weeks earlier, although it s unclear how much lagging ticket sales had to do with the latter. Sizzla Chris Hines, the booker behind the Capleton, Baby Cham and Beenie Man gigs, says Egale and SMM have brought to his attention some lyrics of artists he books. They re telling me the song is an example of homophobia, but I translate it as something else. In Jamaica being homophobic is almost a law. Hines is only marginally overstating the reality. Hundreds of attacks on gays and lesbians, many involving mob violence, and at least three deaths have been reported since the beginning of the year. In April, Amnesty International called on Jamaican authorities to send a clear message that discrimination against sexual minorities will not be tolerated after two incidents involving mob violence against gays in Kingston. If there s been an official response, Jamaican authorities are loath to share it with NOW. Repeated calls, e-mails and faxes sent to the Jamaican High Commission in Ottawa and the consulate in Toronto went unanswered. Hines is sympathetic, but at the same time he can t shake a feeling: It seems that they re just targeting the dancehall community. There are tons of hiphop artists that call people faggot in songs. And they re not going after them. It s a familiar argument, one that was made by local activist Valerie Smith in her efforts last year to have the Ontario Human Rights Commission declare songs with misogynist lyrics hate rap. The stumbling block there is that women are not an identifiable group under the Criminal Code. Gays are. Used to be that SMM would get problem acts to sign a declaration known as the Reggae Compassionate Act. The groups would promise to zip it on the homophobic material in return for avoiding SMM s calls for boycotts, handcuffs and visa denials. One Love and all that. Some acts signed, others recoiled. Problem is there was nothing keeping the bands honest back home. In 2004, a sobering blow came to those who thought that agreements like the Reggae Compassionate Act might have lasting traction in Jamaica. Brian Williamson, a founding member of the Jamaican Forum for Lesbians, All-Sexuals and Gays (J-FLAG), was found brutally murdered. While it s still a matter of some debate whether this was in fact a hate crime, this ultra-public gay-positive force died by violence. Says SMM founder Akim Larcher, What we ve seen is that many of these artists have denied signing, claiming the alleged forgeries are part of the gay agenda. Listeners and concert-goers are often encouraged to revel in derisive singalongs punctuated by exhortations like: Battyman fi dead! Poop man fi drown. Hang chi chi gal wid a long piece of rope. Tek a bazooka and kill batty-fucker. I m dreaming of a new Jamaica, come execute all the gays. Unnecessary translations notwithstanding, the recurring gist of many of these frequently cited tracks is that the sodomite at large (including bowcat bwoys that go down on females) should beware divine wrath right here on earth. To lesser extent, says Larcher, that same homophobic environment exists here in the Caribbean and African communities. These artists remain symbols of hate against the LGBT communities. Beenie Man In the past, artists like Beenie Man and Buju Banton have tried to play both sides of the pond by issuing denunciations of violence against any human being. But one would gather from their continually catalogued concert ramblings that gays and lesbians fall outside of that definition. Until these artists take a public stand in the Caribbean, specifically denouncing violence against gays and lesbians, we don t think they should be allowed into Canada, says Larcher. Buju Banton Case in point is Buju Banton, often heralded as a changed man after penning the anti-gay anthem Boom Bye Bye in the early 90s at the age of 15. But just a few weeks ago, despite calls for his performance to get the hook, he busted out lines from that track at the Guyana Music Festival at the urging of the crowd. Meanwhile, surprise! Posted by Anne Broache It's looking ever less likely that Congress or the courts will act swiftly enough to save Webcasters from the doomsday that they argue will result from imminent new fees. But there are signs that Internet radio players and a group representing artists and record labels may be moving closer to a detente. A few weeks ago, we reported that the increased royalty rates set to kick in July 15 were poised to create a burden not only for small major Webcasters but for the largest ones as well. Because the fee hikes also include a $500 minimum payment per "channel," the three largest Webcasters alone--Yahoo, RealNetworks and Pandora--said they would owe more than $1 billion in the first year alone because of the thousands of unique "channels" their services offer. Now, with the deadline for the fees creeping ever closer and the outcry from Webcasters still at a fever pitch, relief may be on the way. SoundExchange, the nonprofit industry group that lobbied for the changes, told CNET News.com on Thursday--and finalized in a press release (PDF) on Friday--that it has offered the Digital Media Association (DiMA), which counts the major Webcasters among its membership, a $2,500 cap on that annual requirement. "We certainly don't want anybody to get unduly hurt by the minimum fee, but there is a value to music and a cost to administering the digital royalty program, and we wanted to ensure that everyone was treated fairly--artists, webcasters and record labels," John Simson, the organization's executive director, said in a statement. According to DiMA executive director Jonathan Potter, however, there was a catch that wasn't mentioned in SoundExchange's press release. Namely, SoundExchange presented a written offer to apply that reprieve only through 2008, whereas the new U.S. Copyright Royalty Board rates extend through 2010. "Any offer that doesn't cover the full term is simply a stay of execution for Internet radio," Potter said in a statement released Friday afternoon. Indicating that SoundExchange's public statement caught him by surprise, he added that he would have preferred not to be issuing such a statement at all and to be continuing negotiations directly with the music industry group. SoundExchange has already attempted to extend an olive branch to smaller Webcasters that claim the new rules will wipe them off the map. In late May, it floated an offer to freeze through 2010 the "below-market" rates they have been paying since 1998. But SaveNetRadio, a group lobbying against the changes, has argued the approach could stunt the long-term growth of smaller firms if it is based on keeping revenue below certain government-imposed caps. Update at 6:45 a.m. PST: SaveNetRadio spokesman Jake Ward said Monday that the group was encouraged by SoundExchange's recognition that the per-channel payment could be crippling to many Webcasters. He said the ideal solution, however, would be to base the royalty rates on a Webcaster's revenues, as two congressional bills propose--and not, as the copyright officials decided, on the number of songs played and listeners.

Download ASID SAYS NO to Play-OLA and the CRB Pirates URL: New Webcast Royalty Rules Will Line SoundExchange's Pockets With Billions In 'Administrative Fees' There's been plenty of backlash against the new royalty rates for webcasters, set by the Copyright Royalty Board at the suggestion of SoundExchange, a group spun out from the RIAA to handle royalty collection. The royalty rates themselves were ridiculously high, and would make it untenable for many small webcasters to continue, while taking a huge bite out of bigger players' revenues. Now, four of those bigger companies -- Yahoo, RealNetworks, Pandora and Live365 -- have sent a letter to lawmakers pointing out that not only do they have to pay the inflated royalties, they have to pay SoundExchange more than $1 billion a year in "administrative fees" for collecting them as well. The new royalty deal levies a charge of at least $500 per "channel" on webcasters, which SoundExchange says is to cover administrative costs. For somebody like Real, that adds up quickly, since it says it served 400,000 unique channels to its subscribers last year. Furthermore, since they're not royalties, there's a good chance they'll just line SoundExchange's pockets rather than be distributed to artists. This isn't particularly surprising, given SoundExchange's track record (nor its affiliation to the RIAA), but further illustrates how one-sided this royalty deal is. It was crafted only to benefit SoundExchange, and not the artists it purports to represent -- and it certainly doesn't do much for webcasters, other than decimate their industry. Hopefully the webcasters' letter will give a boost to the bill that's been introduced to overturn the CRB decision and set much more reasonable royalty levels.

The CD begins with the Lady Saw song just before the voice of Peaches barks in anger: Dutty, stinking, suck p---y Bounty Killer, weh yuh a call me phone fah? The voices then exchange insults in an expletive-stained, bitter conversation that lasts several minutes At the end of the CD, Peaches voice says, every one ah yuh enemy ah get this, mi record that! One876Entertainment.com interviewed Peaches who describes herself as a brown-skinned girl who looks like DAngel. She said she was forced to record the conversation after Bounty Killer threatened her. It was an actual conversation, he was my man and him start gwaan like him no have no sense, ah talk bout him ah go kick off mi face and kick out mi teeth, so mi record him, and mi copy the threatening text dem to my computer and send it to all my friend dem phone, she said. According to the SoundExchange press release, the offer comes as a direct response to a request from the House Judiciary Subcommittee on Courts, the Internet and Intellectual Property to initiate good faith private negotiations with small commercial and noncommercial webcasters with the shared goal of ensuring their continued operations and viability. The press release also states that the subcommittees request was sent to SoundExchange last week in a letter co-signed by Representatives Howard L. Berman (D-CA) [pictured left] and Howard Coble (R-NC) [pictured below right], the Chairman and Ranking Minority Member respectively of the Subcommittee on Courts, the Internet and Intellectual Property. "As suggested by the Subcommittee," the release states, "SoundExchange is proposing that the subsidy be based on a percentage of revenue model and is proposing the same rates that prevailed under SWSA: small webcasters would pay royalty fees of 10% of all gross revenue up to $250,000, and 12% for all gross revenue above that amount. The proposal includes both a revenue cap and a usage cap to ensure that this subsidy is used only by webcasters of a certain size who are forming or strengthening their business." No details on proposed revenue cap The release did not give any details on SoundExchange's revenue or usage cap. The SWSA-related license for 2005 set a revenue cap of $1.2 million to qualify for the rate. [Previous RAIN coverage of here.] SoundExchange Executive Director John Simson [pictured below] noted that the proposed extension of rates would only be made available to webcasters who comply with reporting requirements and do "not avoid" lawfully-owed payments. The press release states that, "Indeed, in their letter Representatives Berman and Coble noted that, 'In return for compelling sound recording copyright owners to make their works available, the qualifying services agree to meet the terms and conditions of the compulsory license, which, inter alia, requires the periodic filing of statements of account and the timely payment of statutory royalties to the copyright owners whose works they have elected to perform.'" David Oxenford, the lawyer for the Small Commercials Webcasters group to whom such an offer would most likely have been extended, has not yet responded to RAIN's requests for comment. RAIN will continue coverage of this issue in an afternoon edition later today. ... x A step in the right direction, but not a long-term solution SoundExchange's proposal today may take some political pressure off of them, and it does relieve a couple of dozen small webcasters from the threat of imminent bankruptcy, but it addresses only a tiny portion of the big picture. For example, webcasters like Live365 and Pandora are "small businesses" by most standard definitions of the term, but may not qualify for this offer. (SoundExchange's proposed revenue caps have not been publicly released yet.) Launched 18 months ago, Pandora employs 100 people in an enterprise zone in Oakland, California, and under every reasonable definition is a small business trying to grow into a large business. Similarly, Live365 employs 35 people in Foster City, California, and provides the platform for 10,000 individual webcasters to create their own micro-businesses. With That We Say " Beam We Up Selassie I" Judge Says Too Bad To Webcasters Upset About New Webcast Rates from the sorry,-nothing-can-be-done dept Last month, when the RIAA pushed through new webcasting royalty rates that were clearly designed to kill off a lot of webcasters, many people said not to worry, that the whole thing was just part of a negotiation. While the Copyright Royalty Board finally noticed that people weren't too happy about the new rates and agreed to hold some hearings, today they rejected those complaints and said that they won't change the rates, and everyone better pay up by May 15th. Webcasters are now looking to appeal to both the Appeals Court as well as Congress -- but recognize that either move will probably take a while, and go well beyond the May 15th deadline. The end result, of course, is actually going to hurt the music industry greatly. Webcasting has always been a huge promotional driver for artists -- especially niche artists who wouldn't get any publicity any other way. The recording industry apparently still hasn't figured out that it can expand its market by letting people promote the content for it. Instead, it wants to charge for that promotion, in a short-sighted effort to charge for every use of the content, even ones that expand the market and allow the overall industry to make much more money. RIAA Pushes Through Internet Radio Royalty Rates Designed To Kill Webcasts from the broadcasters-must-be-a-special-boys-club dept It's been quite some time since we last heard about arguments between internet webcasters and SoundExchange (a group spun off from the RIAA to handle royalty collection). Back in the summer of 2003, there was even a lawsuit over the royalties being set, that were pretty clearly designed to put smaller, independent webcasters out of business. From the RIAA's point of view, this is perfectly typical. They still view the world (especially the internet) as a broadcast medium. Therefore, they want at small number of "professional" content producers who create the content for everyone else. Then they can just sign a few ridiculously large licenses with those large players, and "the people" get to consume it. It's a fundamental misunderstanding of the internet as a communications medium -- a medium where people express themselves back and forth to each other, rather than a place we go sit back and "consume." While the fight had gotten quiet lately, the good old RIAA was hard at work making sure that things were happening in the background. (AHN) - The Copyright Royalty Board has issued a ruling which will require Internet and streaming radio stations to pay the same royalties that traditional radio stations must pay to the music labels which own the songs they play. Furthermore, the case approved charges retroactively to 2006, meaning many smaller music-streaming and radio-station sites will have to pay far more than they expected, and face shutting down under the enormous costs. Now, only Congress can help smaller web-based radio stations. Currently, Internet radio has been seen as one of the challengers to satellite radio, and actually named as a reason why the Sirius and XM Radio merger wouldn't be an unbeatable trust, since the variety and availability of free Internet radio stations would add competition in the industry. However, now that these stations may go under, Congress may have to intervene. The Zimbabwe electricity Supply Authority (Zesa) Holdings -- a state-run power utility company -- said the shutdown has been necessitated by some inspection work. The blackout would last for 10 hours from 0800hrs to 1800hrs. But officials also warned of load shedding, which could leave some areas oin darkness the whole day. In a notice, Zesa Holdings said the two power stations at Kariba Dam -- namely the South Bank on the Zimbabwe side and the North Bank on the Zambian side -- would shut down on Sunday 8 April to allow international consultants engaged by the Zambezi River Authority to carry out inspection of the downstream side of the dam. In a veiled warning of the possibility to the extension of the shutdown, Zesa added that “updates would be provided on specific issues.” It said: “On the Zimbabwean side, this shutdown implies that power supply to the country will be suppressed by up to 700MW (Kariba station’s generating capacity). "During this period, load shedding will be carried out in order to maintain a balance between supply and demand." This week, the parastatal announced that it would be increasing electricity tariffs by 350 percent in a move that would push the cost of commodities up. In January, Zesa Holdings said it had incurred a loss of 34 billion Zimbabwe dollars (US$136 million) last year by charging sub-economic tariffs. The company warned Zimbabweans to brace themselves for worse power cuts. Zimbabwe has been hit by perennial power shortages due to a shortage of hard currency needed to import excess power, and to refurbish broken down generators at its coal-fired power stations.
