We CAN win together! Normally I dont like to make multiple videos on a single subject unless it is VERY important. This is one of those times. Here are some articles to look at: http://www.betanews.com/article/Angry_YouTube_users_boycott_Viacom_seems_to_respond/1215555799 http://www.socialmediainfluence.com/2008/07/youtubers-prote.html http://osnn.net/comments.php?shownews=15044 I will need all the help I can get with this next video to show the average youtuber what this all means. I wanted to keep people posted on the situation and believe it is a lot worse then people think. I have had some help go over all that is going on with this and have been evaluating what this really means and how it can effect you. We need to keep this momentum going, because they are hoping people will just lose interest and move on, but this is not the time to stop. We need to keep contacting the judges office even more and we also need to have google / youtube appeal this horrible decision. Here is the Judges info: The Judge Judge Louis L Stanton Daniel Patrick Moynihan Courthouse United States Courthouse 500 Pearl St., Room 2250 New York, NY10007 Phones (212) 805-0252 Faxes (212) 805-0389 Please help share this video with other channels and any blogs that deal with freedom of speech and thee right to privacy. My next video will be up in about a week so please subscribe so you will know when it is uploaded. Thanks again for all your support. Here is more information you may want to read: As an interesting aside, CBS announced that YouTube has not harmed them at all and has actually increased their viewership making this lawsuit even more outrageous. Analysts have long been saying that YouTube is a gift for the TV networks: now we have the stats to prove it. CBS announced today that viewers are flocking to their TV shows after seeing the clips on YouTube. Letterman has gained 5 percent (or 200,000 new viewers), while The Late Late Show with Craig Ferguson is up 7 percent (or 100,000 viewers) since the CBS YouTube channel debuted a month ago. They've uploaded 300 clips so far, which have averaged 857,000 views per day in total - that's 29.2 million views on YouTube this month. It's also worth noting that YouTube takes that content to millions of viewers outside of the US who can't access CBS normally - if we could measure the channel's global influence and recognition, I'm sure that will have increased dramatically. CBS has three of the top 25 Most Viewed videos this month, and they have 9 of the Most Viewed videos today (let's hope they're not gaming YouTube!). What's more, they've got nearly 22,000 subscribers. In an Adage article, CBS CEO David Poltrack state: When you have something the public really wants, the economic value in that is to come up with a way to satisfy the rights holders and serve the consumers. That's a lesson that some media companies have been slow to learn. He also said YouTube has yet to do anything to adversely affect his network's programming.

Re: VIACOM VS YOU (Invasion of Privacy)Re: VIACOM VS YOU (Invasion of Privacy)
from Most Discussed
July 06, 2008

We have no way of knowing which click will lead us to a video w/ copyrighted material. Viacom has exclusive rights to it's copyrighted material unless the company grants another entity the right to use the material. Viacom has the right to know who has been fraudulently using their material. Viacom has the right to hold responsible the business who hosts and distributes their material. The average YT user, however, has no way of knowing from a thumbnail if a video will have copyrighted material in it. So, the average YT user shouldn't be held responsible for not being Miss Cleo. Her/His privacy should not be invaded. Anyone who steps out of line, can instantly be 'discredited' for clicking on a video of 'questionable' taste. Gimme 3 minutes of your time. VIACOM is pursuing Google, the owner of YouTube, for copyright issues. Judge Louis Lee Stanton has ruled that Google must turn over our YouTube member IDs along with the corresponding videos watched as well as our computers' IP addresses to Viacom. Copyright issues should concern those who've abused the copyright laws, not those who unknowingly watched the loaded clips. Surely Viacom knows this. This is a blatant invasion of privacy. Instead of whining about what corporations are doing, punish them. Boycott media. Try not spending anything for a couple of days. The following is a list of what Viacom owns. It is taken from their site. http://www.viacom.com/ourbrands/Pages/default.aspx Paramount Pictures DreamWorks Comedy Central BET Network MTV Networks VH1 Vitrual Worlds (The Hills, Laguna Beach, Pimp My Ride) Nickelodeon Quizilla Spike TV TV Land CMT GameTrailers GT Marketplace Harmonix Ifilm AlterEllen.com 365gay.com GoCityKids The Music Factory Game One VIVA QOOB Lazona.com Y2M RateMyProfessors.com College Publisher Neopets ParentsConect URGE Xfire

Google must divulge the viewing habits of every user who has ever watched any video on YouTube, a US court has ruled. The ruling comes as part of Google's legal battle with Viacom over allegations of copyright infringement. Digital rights group the Electronic Frontier Foundation (EFF) called the ruling a set-back to privacy rights . The viewing log, which will be handed to Viacom, contains the log-in ID of users, the computer IP address (online identifier) and video clip details. While the legal battle between the two firms is being contested in the US, it is thought the ruling will apply to YouTube users and their viewing habits everywhere. Viacom, which owns MTV and Paramount Pictures, has alleged that YouTube is guilty of massive copyright infringement. The UK's Premier League association is also seeking class action status with Viacom on the issue, alleging YouTube, which was bought by Google in 2006, has been used to watch football highlights. Legal action When it initiated legal action in March 2007 Viacom said it had identified about 160,000 unauthorised clips of its programmes on the website, which had been viewed more than 1.5 billion times. Following the launch of its billion-dollar lawsuit, YouTube introduced filtering tools in an effort to prevent copyright materials from appearing on the site. The US court declined Viacom's request that Google be forced to hand over the source code of YouTube, saying it was a trade secret that should not be disclosed. But it said privacy concerns expressed by Google about handing over the log were speculative . Google's senior litigation counsel Catherine Lacavera said in a statement: We are disappointed the court granted Viacom's over-reaching demand for viewing history. We will ask Viacom to respect users' privacy and allow us to anonymise the logs before producing them under the court's order. The ruling will see the viewing habits of millions of YouTube users given to Viacom, totalling more than 12 terabytes of data. Viacom said it wanted the data to compare the attractiveness of allegedly infringing video with that of non-infringing videos. YouTube and Google had compelled it to go to court, Viacom said, by continuing to defend their illegal and irresponsible conduct and profiting from copyright infringement, when they could be implementing the safe and legal user generated content experience they promise . It said it would not be asking for any personally identifiable information of any user. Any information that we or our outside advisors obtain will be used exclusively for the purpose of proving our case against You Tube and Google (and) will be handled subject to a court protective order and in a highly confidential manner. 'Erroneous ruling' Leading privacy expert Simon Davies told BBC News that the privacy of millions of YouTube users was threatened. He said: The chickens have come home to roost for Google. Their arrogance and refusal to listen to friendly advice has resulted in the privacy of tens of millions being placed under threat. Mr Davies said privacy campaigners had warned Google for years that IP addresses were personally identifiable information. Google pledged last year to anonymise IP addresses for search information but it has said nothing about YouTube data. Mr Davies said: Governments and organisations are realising that companies like Google have a warehouse full of data. And while that data is stored it is under threat of being used and putting privacy in danger. The EFF said: The Court's erroneous ruling is a set-back to privacy rights, and will allow Viacom to see what you are watching on YouTube. We urge Viacom to back off this overbroad request and Google to take all steps necessary to challenge this order and protect the rights of its users. The body said the ruling was also potentially unlawful because the log data did contain personally identifiable data. The court also ruled that Google disclose to Viacom the details of all videos that have been removed from the site for any reason.

Protest the decision: http://www.petitiononline.com/privacy9/petition.html The judge in the Viacom v. YouTube/Google case has just ordered that YouTube/Google turn over records of every viewing of every video since the site launched. That includes your private user data of every video you have watched. New York Times article: http://tinyurl.com/5td7hr Is it time to boycott Viacom? Or is it time to stop watching YouTube (to protect our privacy)? UPDATE: YouTube responds on their blog: http://www.youtube.com/blog?entry=Gh2N9xyKK8k UPDATE TWO: Since recording this, I've realized that my anger is misplaced. Viacom can ask for whatever they want, the real villain here is the judge who agreed with them, rather than follow the U.S. constitution's privacy provisions. Any protests should be focussed on the judge and the ruling (in a peaceful, non-violent, and legal manner, of course).
