House Appropriations Committee s Subcommittee on Financial Services and General Government Hearing on Public, Educational, and Governmental (PEG) Access to Cable TelevisionFor immediate release September 18, 2008US House Subcommittee will ask FCC to examine harm to public, educational, and governmental acess television In response to testimony from Alliance for Community Media members yesterday, the House Appropriations Committee s Subcommittee on Financial Services and General Government voiced strong bi-partisan support for public, educational, and governmental (PEG) access for communities and asked the FCC to examine whether AT s New York chapter, and Executive Director of BronxNet, presented testimony that detailed multiple problems with PEG access channel delivery arising out of recent actions by the FCC, state legislatures, the cable industry and AT channel slamming ), reduced quality and functionality of existing channels, and loss or reductions in public cable drops to schools, libraries and other public centers. Regarding the issues of AT s treatment of PEG channels, Ms. Popovic said Bottom line, AT choice in cable franchising, is giving viewers no choice when it comes to PEG. Mr. Knobbe discussed the problems associated with channel slamming, which include additional costs to consumers to view PEG channels.FCC Media Bureau Chief Monica Desai agreed that at least one of these practices may be illegal, stating We believe that placing PEG channels on any tier other than the basic service tier may be a violation of the statute. When asked why the FCC was not enforcing that provision of the statute, Ms. Desai indicated that the FCC needed a formal complaint in order to act, and had not received any. In response, Subcommittee member Adam Schiff (CA-D) stated that he believed the FCC had authority to enforce the law whether or not they d received complaints.In closing, Subcommittee Chairman Serrano (NY-D) and Representative Kirk (IL-R) announced that they would send a letter to the FCC asking it to deal with the issues raised at the hearing.http://www.ourchannels.org/?p=202

VERIZON and AT s 700 MHz wireless spectrum auction. Verizon Wireless will pay $9.4 billion for 109 licenses while AT s BD-Live functionality and wireless communication with PlayStation Portables. The PS3 will become the first Blu-ray player on the market with Internet access, offering a wide variety of downloadable movie trailers, bonus material and more. Meanwhile, Toshiba announced that its HD DVD flop will cost the company $1.1 billion. ONLINE ADVERTISING is under attack in a new bill proposed by New York assemblyman Richard Brodsky. The bill would make it illegal for companies to track information about Internet users for advertising purposes without their consent. It would also require the choice to opt-out of targeted advertising based on web searches, browsing history and other private data. Microsoft, AOL and Yahoo are all sending lobbyists to Albany due to the growing support for the bill. DIRECTV launched a new satellite that will allow it to offer 150 national HD channels and local HD channels in over 100 markets. It is expected to begin service this September. DirecTV will launch another satellite in 2009, providing support for up to 200 national HD channels. Of course, earlier this week Dish Network reported problems with its own satellite launch, which may hurt its performance in the growing battle for HD supremacy. QUADRANT ONE received a major boost on Thursday, adding 26 newspaper companies to the online ad network of newspaper publishers. McClatchy and Media General were among the additions. QuadrantOne was started by the Tribune Co., Gannett, the New York Times Co. and Hearst Corp. to offer advertisers a one-stop-shop for placing ads in newspapers across the country. The new additions have doubled the network size, bringing it close to 250 newspapers. In related news, the Tribune Co. will reportedly offer Newsday up for sale. THE FCC announced that the 700 MHz spectrum auction ended after raising over $19 billion, making it the most profitable government auction in history. Winners will be revealed within the next few days. One failure was the insufficient bidding for the D-block, which required winners to share spectrum with public safety organizations. The D-block is expected to be re-auctioned with fewer regulations. APPLE is in talks with music labels about offering unlimited downloads from the iTunes Music Store. The company is planning two different business models: a monthly subscription plan and unlimited access for the life of an iPod or iPhone in exchange for a higher purchase price. Apple is currently haggling with labels over the appropriate price for the service. In other Apple news, Adobe announced that it has begun work on a new Flash media player designed for the iPhone. GENERAL MOTORS will shift half of its $3 billion advertising budget to online and one-to-one marketing within 3 years. That indicates a rapid increase over the $197 million GM spent online last year. The company plans to offer a wide variety of formats, including gaming, search, interactive applications and more. FACEBOOK will launch an instant-messaging service, allowing users to chat in real time on Facebook.com. The service should provide serious competition to AOL s popular Instant Messenger service. The site has also added enhanced privacy functions, giving users detailed control over what parts of their profile specific friends and acquaintances can access. After the Beacon fiasco, any increase in privacy should be welcomed by users. CABLEVISION will soon begin delivering 15 Voom HD channels using switched digital video. The change will require a new HD set-top box that will be offered free to consumers for one year. Expected roll out is sometime in April or May. ANTIGUA is threatening to repeal intellectual property treaties with the United States and to allow massive copyright infringement on the island if the U.S. doesn t hasten its response to pending trade disputes. A representative of the island said that the United States is not negotiating fairly in a dispute over Internet gambling. The World Trade Organization has already determined that the U.S. owes Antigua $21 million but has not sanctioned stealing music, movies and more as a proper settlement. SHELLY PALMER reveals what really caused Oprah s online video meltdown.PROJECT CANOE continues to develop as the major cable companies host monthly meetings in New York and Philadelphia. The targeted and interactive advertising initiative is bringing together Comcast, Time Warner Cable, Cablevision, Cox, Charter and Bright house Networks. The companies are expected to fund a new company with an initial $150 million to create a national service that allows advertisers to purchase spots across all six cable networks. The service will also offer interactive ads.PARAMOUNT will make clips from thousands of movies available online through a new Facebook application called Voozoo. Users will be able to send the clips to other users and each clip will include a link to purchase the film s DVD. Paramount is in talks with other studios to add their content.MYSPACE has increased talks with the major music labels about offering a new online music service through the social network. SONY BMG, Warner Music and EMI are expected to sign on before the end of the month. Universal Music is holding out due to a pending copyright lawsuit with MySpace, which it wants to settle before entering into a business relationship.THE WB may resurface as an online network. The network would offer online streaming of Dawson s Creek, Buffy the Vampire Slayer and other WB classics. Talks are underway to secure the online rights to the content before a soft launch next month.FOX saw its web traffic increase 101% in January due to the return of American Idol, Prison Break and other shows. 4.6 million unique users visited the network site during the month. NBC.com and ABC.com still hold the lead, with close to 8 million unique users every month. CBS.com draws 4.5 million.

THE DISNEY-ABC TELEVISION GROUP has officially announced Stage 9, a new digital media studio. The studio s first project is Squeegees, an online comedy show about a group of bumbling window washers. The 5-minute episodes will be released on Mondays and Fridays on both YouTube and ABC.com. However, this new media studio made a decidedly old media move by disabling the embedding of episodes. Disney seems bent on losing the benefit of word-of-mouth, as users cannot add the shows to blogs or social-networking profiles. It doesn t take long to copy an episode, upload it to YouTube on a regular account, and embed it anywhere on the web without the Toyota banners and pre-rolls that currently support the show. Disney should avoid this fate and simply allow embedding. NBC canceled the show Quarterlife after its first episode debuted to incredibly low ratings. Bravo will reportedly run the full 13-episode Internet series instead. Creator Marshall Herskovitz tempered his earlier caustic comments about the experiment by releasing a statement saying he was deeply grateful for NBC s effort. SAG announced that it will not start formal negotiations with the AMPTP until April at the earliest. Until then, the Guild will hold internal meetings to prepare its proposal. The Guild also needs to resolve the details of joint bargaining with AFTRA. CABLEVISION and TICKETMASTER are reportedly in talks to acquire 49% of AEG Live, the country s second largest concert promoter. The deal would connect major concert venues across the country (including Madison Square Garden), Fuse TV and more with Ticketmaster s market dominance and AEG s promotional engine. Live Nation, another concert promoter, recently broke off a partnership with Ticketmaster to start its own ticketing business. PLUS: YouTube will add live video sometime in 2008, according to co-founder Steve Chen. Family Guy creator Seth MacFarlane has a new online show in the works that will be distributed by Google. And earlier this week Nielsen canceled its ambitious Project Apollo, which tested Arbitron s people meters for use in tracking a combination of media consumption and purchasing habits. GOOGLE CEO Eric Schmidt phoned YAHOO s Jerry Yang on Friday to offer some sort of help in avoiding a MICROSOFT takeover. No details of the call have been released but there is speculation that it could involve Yahoo outsourcing its search business to Google. Google has posted a reaction to the takeover bid on its blog, saying a combined Microsoft-Yahoo will threaten the openness and innovation of the Internet. Microsoft s General Counsel responded by saying the deal would create a more competitive marketplace. Meanwhile, the House of Representatives has scheduled a hearing on the issue for this Friday. CABLEVISION is expected to officially announce a new service that offers a combination of DVD purchasing and instant VOD access to content. Viewers will be able to order a DVD through a VOD channel on the same day it hits stores and then begin watching the feature immediately. The service is a partnership with Popcorn Home Entertainment. Content will be available from Warner Bros. and Universal. THE WGA and the AMPTP have reportedly made major breakthroughs in negotiation talks and an agreement is expected soon. Streaming rights have been agreed upon and lawyers are drafting contracts, which will be reviewed by the negotiating committees. However, the Guild presidents have told its members that no deal is firmly in place yet and that picketing must continue. ESPN will slightly open the gate to ESPN 360 s walled garden, offering free access to users in the .edu and .mil domains and potentially doubling its audience. The site offers live, online streaming of full-length sporting events. Until now it has only been available to users whose ISP s have cut deals with ESPN. The company is hoping to migrate the cable business model to the web but this may be a sign that this approach is not working. NATIONAL GEOGRAPHIC is launching a reorganized broadband video site with multiple genre channels. 1500 clips will be offered with ad support. Most clips will be short, with a new long video added each week. The reorganization comes after Nation Geographic found much higher activity on the NGC Wild site, which uses the genre model.
